01 Agreement to Terms

By accessing or using InfoPeak ("the Service"), operated by InfoPeak (CVR: 42161543), Mergelsigvej 10, DK-7400 Herning, Denmark, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

These terms apply to all visitors, users, and members of the Service. Supplementary terms or policies referenced herein are incorporated by reference.

02 Description of the Service

InfoPeak is a privacy-first digital productivity suite that includes email, cloud storage, documents, spreadsheets, presentations, calendar, contacts, notes, VPN, password management, and DNS filtering. All services are hosted exclusively within the European Union.

We also offer InfoPeak Captcha, a bot-protection service that you may embed on websites you operate. It is provided under these Terms as a separate service from the productivity suite, and is subject to the site key, domain binding, and monthly verification limits of the plan you select. You are responsible for the websites on which you deploy it and for informing your own visitors as required by applicable law.

03 Accounts & Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. InfoPeak cannot recover your data if you lose your encryption passphrase due to our zero-knowledge architecture.

You must be at least 16 years of age to create an account. By creating an account, you confirm that you meet this requirement.

04 Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights.
• Distribute malware, spam, or engage in phishing or other fraudulent activities.
• Attempt to gain unauthorized access to other accounts or systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service for disposable, single-use, or throwaway accounts. InfoPeak is intended as a genuine, lasting home for your data -not a temporary or short-lived service. We reserve the right to suspend or delete accounts that are used in this manner.

Violation of these rules may result in suspension or termination of your account.

05 Your Data & Intellectual Property

You retain full ownership of all content you upload, create, or store in InfoPeak. We do not claim any intellectual property rights over your data. Our zero-knowledge encryption means we cannot access the content of your encrypted files, messages, or passwords.

You grant InfoPeak a limited, non-exclusive license solely to provide, maintain, and improve the Service -for example, to store encrypted data on our servers and transmit it to your devices.

06 Subscriptions & Payment

InfoPeak offers paid subscription plans billed monthly or annually. Prices are displayed in your local currency (EUR, DKK, SEK, NOK, or USD) based on your language or location. Payment is processed by our third-party payment provider; InfoPeak does not store your payment card details.

Subscriptions renew automatically unless cancelled before the end of the current billing period. You may cancel at any time through your account settings. Upon cancellation, you retain access until the end of the paid period.

You may change your plan at any time from your account settings. Plan changes take effect on your next billing date -you keep your current plan and features until then. We do not prorate or refund the current billing period when you change plans.

New users may start a 30-day free trial of the Professional plan -no credit card required. At the end of the trial period, a paid subscription is required to continue on Professional; otherwise the account automatically continues on the Free plan. Personal and Family have no trial period - you subscribe directly and may cancel at any time. Your email address is retained in our records to prevent repeated creation of trial accounts with the same address.

07 Data Portability & Account Closure

You may export your data at any time using the built-in export features. InfoPeak supports standard formats including JSON, CSV, PDF, and DOCX. Upon account deletion, all your data -including encrypted content, metadata, and backups -will be permanently deleted from our servers within 30 days.

08 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for scheduled maintenance, updates, or circumstances beyond our control. We will provide reasonable notice for planned maintenance when possible.

09 Limitation of Liability

To the maximum extent permitted by applicable law, InfoPeak shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities, arising from your use of the Service.

Our total aggregate liability shall not exceed the amount you paid to InfoPeak in the twelve (12) months preceding the event giving rise to the claim.

10 Changes to These Terms

We may update these Terms of Service from time to time. Significant changes will be communicated via email or a prominent notice on our website at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the updated terms.

11 Governing Law & Disputes

These terms are governed by the laws of Denmark and the European Union. Any disputes arising from these terms shall be resolved by the competent courts in Denmark, without prejudice to any mandatory consumer protection provisions in your country of residence.
